1. What is GDPR?

2. What is CCPA?
CCPA stands for California Consumer Privacy Act. CCPA is a consumer protection law intended to enhance privacy rights and consumer protection for residents of California, United States. CCPA is being enforced starting on July 1 2020.
3. How do GDPR and CCPA affect me?
GDPR and CCPA are designed to protect the individual and their privacy. There is nothing you need to do as a user, as you benefit from them by default. As a company, we're responsible for complying with these regulations to protect yo and your privacy.
4. Why do you collect user data?
We are always on a mission to get to know our users so we can meet their needs. Like all apps, we need some of your data so that we can provide you with the best possible service. Without the collection of this data, we would not be able to: make sure you're able to access our servers, provide a user friendly experience, offer personalization within the app, and correct issues that arise during use. We are committed to provide you with the best mental health help possible, while protecting your privacy.
5. Which data are you gathering?
When you create an account with Pocketcoach we gather data like name, e-mail address, billing data, IP address as well as access data. Likewise, if you decide to subscribe to our newsletter, you also agree to the processing of your e-mail and sometimes your name.
When you use our app and connect to our servers, there are certain kinds of data that are automatically generated to ensure that we provide you with the desired services. The processing of this kind technical data is required to provide you with a user friendly and secure app.
Examples of this data are: name of the accessed site, date and time of access, transmitted quantity of data, server status codes, username, processing time, browser and client type alongside the version, your operating system, referrer URL (the previously visited site), IP-address and the requesting provider, reverse DNS, location data, connection data, source and target (network discovery or address, port numbers, protocol, e-mail address, e-mail subject, connecting server, protocol details, reputation data, reverse DNS, obvious labeling, connected servers), authentication details and e-mail meta information.
We also collect and process data related to the maintenance and restoring of services should the app crash. If the app crashes a crash report is sent to us, and the gathering of the following data would not be possible without your consent: IP-address of your device, your operating system, the requested files from our app, screen resolution, phone model, your click behavior in the app (time of access, use of certain features) as well as the source you install the app from.
We process the data of your user account solely for operating your account, the provision of our services as well as for the billing of our services. This data processing is therefore necessary for the fulfillment of our pre-contractual obligations.
6. Can Pocketcoach collect data without my consent?
Some data, such as name, contact information, and payment data for example is required for providing the user with the agreed service. This data can be processed without consent. However, this does not apply to health data (Art 9 GDPR).
7. Can Pocketcoach collect my mental health data?
No one can gather your mental health data without your consent. We process this data only with your prior consent. However, in order to be able to help you, we need to know how you feel and what you struggle with. That's why we need your consent in order for you to use the app. No one is allowed to gather your mental health data, or any health data for that matter, without your consent. You can revoke this consent at any time without offering a reason.
8. What are we doing with your data?
We collect data to be able to understand if our services function correctly and make sure we can assist you if something goes wrong. We also use this data to understand which features provide the best help for our users and improve our services. We use this usage data for analysis, improvements of our services and our app and increasing usability. This data processing takes place on the basis of your consent to the use of tools in our app.
9. What if I don't consent?
As an example, when you start using the Pocketcoach app , we ask you how are you feeling at the moment and based on your response we guide you through the best course for you. Without your consent to process your mental health data, we won't know how can we best help you.
Other things like the newsletter subscription and tracking tools consent are optional.
10. How do I withdraw consent?
You can withdraw consent at any time with immediate effect. To do this, you can contact us via e-mail to [email protected] You can also request the removal of all your data via e-mail. With regards to the data provided when you sign up for our newsletter, you can withdraw your consent through the unsubscribe link in our e-mail newsletters also with immediate effect. Additionally, if you delete your account within the app, your personally identifiable information will be removed.
